Who gets a fair trial? I use to believe in the jury system. I use to believe that when six reasonable people listen to the evidence and talk it out they can usually get it right. As long as the people are fair and open-minded at the beginning of the case, the trial system– especially the jury trial system — works.
I have been a trial lawyer for almost 25 years. Every year I worry more and more about the entire civil legal system. I still believe that criminal courts, by and large, get fair trials. But that is no longer the case in civil court. People no longer get a fair trial.
This is not the same old message about the plaintiffs taking advantage of a weak system. Or about plaintiffs
