Aviation Accidents

Aviation law governs the operation of aircraft and the maintenance of aviation facilities. Both Federal and State governments have enacted statutes and created administrative agencies to regulate air traffic. In aviation litigation, there is a "Statute of Repose" that limits the time a lawsuit can be filed based on how long the airplane or part has been in service. This time limit varies based on the jurisdiction of the case. Potentially liable parties vary depending on the cause of the accident. Under certain circumstances, an owner or operator of the aircraft may be found liable; in others, manufacturers or maintenance suppliers may be liable. This depends upon the cases and the circumstances surrounding the case.

A nine-year joint study by Boeing and US ATA showed that aviation maintenance errors were a major factor in aircraft accidents. It also showed that 50 percent of flight cancellations and delays are due to engine problems caused by maintenance errors. In 2000, there were 1,861 aircrafts involved in accidents according to the National Transportation Safety Board. There were 596 fatalities involved in these accidents.
